GENERAL TERMS AND CONDITIONS OF CONTRACT

1. OBJECT

These General Terms and Conditions of Sale govern the purchase of products offered through the website www.reyalfombrillas.es (hereinafter, the "Website"), owned by EL REY DE LAS MOQUETAS SL

Placing any order implies the express, full and unreserved acceptance of these General Terms and Conditions of Contract, as well as the Legal Notice, Privacy Policy, Cookies Policy, Payment, Shipping and Billing Policy and Returns Policy, all of which are permanently available on the Website.

These conditions exclusively regulate the contractual relationship between EL REY DE LAS MOQUETAS SL and customers who purchase products through the Website.

3. USERS AND CAPACITY TO CONTRACT

Only individuals over eighteen (18) years of age who have sufficient legal capacity to contract may make purchases on this Website.

Legal entities must act through a representative with sufficient powers to bind the entity.

The Client declares that all information provided during the purchase process is true, accurate and up-to-date, undertaking to communicate any modification that could affect the correct execution of the contract.

EL REY DE LAS MOQUETAS SL may reject orders when there are reasonable indications of fraud, identity theft, misuse of payment methods or any other circumstance that may compromise the security of the operation.

4. PURCHASE PROCESS

To place an order, the Customer must select the desired products and add them to the shopping cart.

You will then need to provide the necessary information for processing the order, select the shipping method and the payment method available for your geographical area.

Before finalizing the purchase, the Customer will be able to review all order details and correct any possible errors.

The formalization of the order will require the express acceptance of these General Terms and Conditions of Contract and the Privacy Policy by means of the corresponding acceptance box.

Once the order is confirmed, the Customer will receive an email acknowledging receipt of the order.

Automatic receipt of the order does not imply final acceptance of the sales contract.

The contract will be considered perfected only when EL REY DE LAS MOQUETAS SL confirms the effective shipment of the order.

5. PRODUCT AVAILABILITY AND CONTRACT FORMATION

All orders are subject to the actual availability of the products.

Most of the products sold by EL REY DE LAS MOQUETAS SL are manufactured specifically for each vehicle once the order is received.

Consequently, placing the order initiates the internal process of manufacturing, preparing, or supplying the requested product.

In the event of a supervening manufacturing impossibility, an availability error or any other circumstance that prevents the supply of the requested product, EL REY DE LAS MOQUETAS SL will inform the Customer as soon as possible.

In such a case, the Client may choose between:

• Wait for the product to be restocked.
• Replace it with another of similar characteristics, when possible.
• Request a full refund of the amounts paid.

When the order includes products made to order or customized, once the manufacturing process has begun it may not be possible to modify, cancel or replace said products, without prejudice to the rights that legally correspond to the consumer.

6. PRICING AND PRICING ERRORS

All prices published on the Website are expressed in euros (€) and include the Value Added Tax (VAT) applicable in accordance with current legislation.

Shipping costs will be itemized during the purchase process before final order confirmation.

Promotions, discounts and commercial campaigns will have the duration indicated in each case and will not be cumulative unless expressly stated otherwise.

Obvious errors

EL REY DE LAS MOQUETAS SL takes all reasonable measures to ensure that the published prices are correct.

However, typographical, computer or human errors may occur that affect the displayed price.

When the published price is clearly erroneous and objectively recognizable as such by any average consumer, EL REY DE LAS MOQUETAS SL will not be obliged to supply the product at that price.

In such a case, the Client will be informed immediately, and may choose between:

• Confirm the order with the correct price.
• Cancel the order and receive a full refund of any amount paid.

7. PAYMENT METHODS

Payment transactions are carried out through secure connections protected by SSL encryption.

EL REY DE LAS MOQUETAS SL does not store the complete details of the bank cards used during the purchase process.

Payment data is processed directly by the relevant financial institutions or payment service providers.

Available payment methods may vary depending on the country from which the purchase is made or the device used.

In general, the Customer may use one of the following payment methods:

• Debit or credit card.
• Bizum (available only in Spain).
• Google Pay.
• Apple Pay.
• PayPal.
• PayPal financed in 3 months.
• Bank transfer.
• Revolut Pay.

EL REY DE LAS MOQUETAS SL may add, modify or remove payment methods when necessary for technical, commercial or third-party agreement reasons.

8. BILLING

All orders will be invoiced in accordance with applicable Spanish and European tax regulations.

The invoice for the purchase will be available electronically in the customer area once the order has been shipped and its status is marked as "Shipped".

By accepting these General Terms and Conditions, the Client consents to the issuance of the invoice in electronic format.

However, you can request a free paper copy by contacting our customer service department.

It will be the Customer's responsibility to verify that the billing information provided during the purchase process is correct.

Once the invoice has been issued, modifications can only be made when permitted by current tax regulations.

9. MANUFACTURING, PREPARATION AND TIMEFRAMES

The delivery times indicated on the Website consist of the preparation or manufacturing time of the product plus the transit time of the transport company.

Saturdays, Sundays and national, regional or local holidays in the Community of Madrid will not be considered working days for the purposes of manufacturing, preparation or delivery.

In general, the products marketed by EL REY DE LAS MOQUETAS SL can be classified into the following categories:

Products in stock: Products available for immediate shipment, whose usual preparation time is approximately 24 working hours.

Products manufactured to order: Certain carpet, velour, fabric or other ranges of mats made specifically for the selected vehicle require an individualized manufacturing process whose estimated time may range between 2 and 8 working days, without prejudice to possible variations derived from the production load, availability of materials or extraordinary circumstances.

The indicated deadlines are indicative and do not constitute a contractual commitment to delivery on a specific date.

When, due to exceptional circumstances, a significant delay is expected with respect to the initially estimated deadline, EL REY DE LAS MOQUETAS SL will inform the Client by email.

When an order includes products with different manufacturing or availability times, EL REY DE LAS MOQUETAS SL may make partial shipments when this allows reducing the Customer's waiting time, at no additional cost.

10. SHIPPING AND SPECIAL AREAS

Shipments are made exclusively to destinations available during the purchase process.

The modes of transport, fares and deadlines may be modified when necessary to ensure adequate service provision.

Shipping costs will be calculated automatically during the purchase process based on the destination, order amount, and current promotions.

Once the order has been shipped, the Customer will receive an email with the tracking information provided by the shipping company.

The published transit times are estimates provided by the transport agencies and may be affected by circumstances beyond the control of EL REY DE LAS MOQUETAS SL

In certain territories there may be logistical restrictions, delivery limitations or additional costs arising from customs or tax procedures, which will be informed to the Customer when applicable.

11. DELIVERY, RISK TRANSFER AND INCIDENTS

Responsibility for the products will remain with EL REY DE LAS MOQUETAS SL until the order is physically delivered to the Customer or the person authorized to receive it at the address indicated during the purchase.

From that moment on, the risk of loss, theft, deterioration or accidental damage to the product will be assumed by the Customer in accordance with current consumer regulations.

In the event of loss of the shipment during transport or impossibility of delivery due to causes attributable to the transport company contracted by EL REY DE LAS MOQUETAS SL, the company will manage the incident by offering, as appropriate, a new shipment or a full refund of the amount paid.

Receiving damaged packages

If the packaging shows signs of damage, breakage, deformation, or any other visible indication of having been damaged during transport, the Customer is advised to:

• Expressly inform the carrier of this circumstance at the time of delivery.
• Photograph the exterior condition of the package before opening it.
• Keep the original packaging.
• Photograph any damage observed on the product.
• Report the incident to EL REY DE LAS MOQUETAS SL within the first 24 hours of receipt.

Communication outside of this period will not limit the legally recognized rights of the consumer, although it may hinder the processing of the claim against the transport company.

Failed deliveries

When an order is returned due to causes attributable to the Customer, such as incorrect address, repeated absence, unjustified refusal of the shipment or failure to comply with the requirements necessary for delivery, EL REY DE LAS MOQUETAS SL may pass on the logistical costs actually incurred to proceed with a new shipment or make the corresponding refund.

12. VEHICLE COMPATIBILITY, CUSTOM PRODUCTS AND IMAGES

Most of the floor mats sold by EL REY DE LAS MOQUETAS SL are manufactured specifically for a particular vehicle model.

It is the Customer's sole responsibility to verify that they have selected the correct items before placing their order:

• Brand.
• Model.
• Year of manufacture.
• Bodywork.
• Motorization where applicable.
• Fixing system.
• Any other characteristics necessary to correctly identify the vehicle.

Certain manufacturers make design modifications during the commercial life of the same model (restyling, platform changes, interior modifications or variations in anchoring systems), which can result in differences between seemingly identical vehicles.

The photographs, renders, images, configurators and simulations available on the Website are for illustrative purposes only.

Likewise, the colors of the carpet, piping, stitching, logos and other finishes may present slight variations from the images shown due to:

• Customer-used screen configuration.
• Lighting used during the taking of the photographs.
• Differences between manufacturing batches.
• Characteristics specific to textile materials.

These small differences will not be considered a manufacturing defect.

Manufacturing tolerances

The mats are individually made products.

As a result of the manufacturing process itself, there may be small dimensional tolerances, slight variations in seams, piping, embroidery, colors or

finishes that do not affect the functionality, safety or adaptation of the product to the vehicle.

These variations inherent to the production process will not constitute a lack of conformity nor will they give the right to return or replace the product.

13. LEGAL GUARANTEE

All products marketed by EL REY DE LAS MOQUETAS SL have the legal guarantee of conformity provided for in Royal Legislative Decree 1/2007.

The warranty covers only non-conformities existing at the time of delivery of the product.

These include, among others:

• Manufacturing defects.
• Manufacturing errors.
• Defective seams.
• Structural defects in materials.
• Defects in the original supplied fastening systems.

The following are excluded from the warranty:

• Normal wear and tear from use.
• The abrasion of the carpet due to continued use.
• Damage caused by incorrect installation.
• Cuts, perforations or modifications made by the Client.
• Inadequate cleaning.
• Negligent use.
• Use other than that intended for the product.

When it is necessary to verify the incident, EL REY DE LAS MOQUETAS SL may request photographs, videos or any other information that allows an initial diagnosis before requesting the shipment of the product.

14. PRODUCT EXCHANGES

EL REY DE LAS MOQUETAS SL does not make direct product exchanges.

When a product allows the exercise of the right of withdrawal, the Customer may process the return in accordance with the Returns Policy and subsequently place a new order with the desired item.

In the case of customized products made specifically for a particular vehicle, changes can only be made when there is an error attributable to EL REY DE LAS MOQUETAS SL or a lack of conformity covered by the legal guarantee.

15. RIGHT OF WITHDRAWAL

Consumers and users generally have a period of fourteen (14) calendar days from receipt of the order to exercise the right of withdrawal under the terms provided for in Royal Legislative Decree 1/2007.

However, this right will not apply in those cases expressly excluded by current regulations.

The procedure, requirements, exceptions, return costs and other applicable conditions can be found in the Returns Policy, which forms an integral part of these General Terms and Conditions.

16. PRODUCTS EXCLUDED FROM WITHDRAWAL AND DEPRECIATION

In accordance with Article 103.c) of Royal Legislative Decree 1/2007, the right of withdrawal may not be exercised with respect to products made according to the consumer's specifications or clearly personalized.

This consideration will include, among others, floor mats specifically manufactured for the vehicle model selected by the Customer.

For those products to which the right of withdrawal applies, the Customer will only be responsible for the decrease in value resulting from handling other than that necessary to verify its nature, characteristics and functioning.

When the product shows signs of use, dirt, damage, deterioration of the original packaging or any other circumstance that prevents its sale as a new product, EL REY DE LAS MOQUETAS SL may apply an objective and proportionate depreciation on the amount to be refunded, which may reach 100% when the product is unusable for a new sale.

17. LIABILITY, LIMITATION OF LIABILITY AND RETENTION OF TITLE

EL REY DE LAS MOQUETAS SL will respond to consumers in accordance with current consumer legislation.

Outside of the cases established by mandatory rules, the liability of EL REY DE LAS MOQUETAS SL will be limited to the direct damages that are an immediate consequence of the breach of contract.

In particular, EL REY DE LAS MOQUETAS SL will not be responsible for:

• Damage resulting from incorrect installation of the mats or supplied accessories.
• Damage caused by using the product for a purpose other than that for which it was designed.
• Damages resulting from modifications, cuts, perforations or adaptations made by the Client or by third parties.
• Damage caused by the removal or alteration of the vehicle's original fastening systems.
• Normal wear and tear from continued use of the product.
• Normal variations in color, texture or finish resulting from the manufacturing process itself or the natural aging of the materials.
• Indirect damages, loss of profits, loss of business opportunities or any other economic damage that does not directly result from the breach of contract, except where applicable law provides otherwise.

Reservation of ownership

Ownership of the supplied products will remain with EL REY DE LAS MOQUETAS SL until full and effective payment of the agreed price has been made.

18. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the Website, including but not limited to text, photographs, images, designs, configurators, patterns, logos, trademarks, trade names, software, databases, videos, graphics and other elements, are protected by intellectual and industrial property legislation.

Its ownership belongs to EL REY DE LAS MOQUETAS SL or to third parties who have authorized its use.

The reproduction, distribution, transformation, public communication, extraction, reuse or total or partial exploitation of said contents is prohibited without prior written authorization from its owner, except in the cases legally permitted.

The vehicle manufacturer brands that may appear on the Website belong to their respective owners and are used solely for descriptive purposes to identify the compatibility of the products offered.

19. PROTECTION OF PERSONAL DATA

The personal data provided during the purchase process will be processed by EL REY DE LAS MOQUETAS SL in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 and other applicable regulations.

The main purpose of the processing will be to manage the contractual relationship derived from the purchase, including the customized manufacture of the products, administrative, logistical, tax, accounting management, warranties and after-sales service.

20. COOKIES

The Website uses its own and third-party cookies for technical, analytical, functional and, where applicable, advertising purposes, with the aim of improving the browsing experience and the functioning of the platform.

21. FORCE MAJEURE

EL REY DE LAS MOQUETAS SL will not be liable for delays or failures to perform its obligations when these are due to unforeseeable or unavoidable events beyond its reasonable control.

By way of example only, the following shall be considered as causes of force majeure or extraordinary circumstances:

• Fires, floods or natural disasters.
• Exceptional meteorological phenomena.
• Pandemics, epidemics, or health emergencies.
• General strikes or labor disputes that affect production or transport.
• Interruptions in the supply of electricity, telecommunications or essential services.
• Sudden shortage of raw materials.
• Delays attributable to manufacturers, suppliers or transport companies.
• Legal, administrative or customs restrictions imposed by competent authorities.

• Any other extraordinary circumstance that reasonably prevents the normal fulfillment of the obligations assumed.

When any of these circumstances occur, EL REY DE LAS MOQUETAS SL will inform the Client as soon as reasonably possible and will take appropriate measures to minimize their effects.

The existence of a force majeure event shall not, under any circumstances, imply a limitation of the inalienable rights recognized to consumers by current regulations.

22. MODIFICATION OF THESE CONDITIONS

EL REY DE LAS MOQUETAS SL may modify these General Terms and Conditions of Contract when necessary to adapt them to legislative changes, judicial resolutions, administrative criteria, technical improvements of the Website or modifications in commercial operations.

The modifications will not affect orders already placed, which will continue to be governed by the conditions in force on the date the contract was signed.

The current version will always be the one published on the Website.

23. PARTIAL NULLITY

If any of the clauses contained in these General Conditions are declared totally or partially null, invalid or unenforceable by a final decision issued by a jurisdictional body or competent authority, such nullity will only affect the specific provision.

The remaining clauses will retain their full validity and effectiveness, provided that this is legally possible.

24. APPLICABLE LAW, LANGUAGE AND DISPUTE RESOLUTION

These General Terms and Conditions of Contract shall be governed by and construed in accordance with Spanish law.

In case of controversy, both parties will submit to the Courts and Tribunals that are competent in accordance with the regulations for the protection of consumers and users, without prejudice to the inalienable rights recognized by said regulations.

The official language for the conclusion of the contract is Spanish.

In the event that these General Terms and Conditions are translated into other languages, the version written in Spanish shall prevail over any translation in case of discrepancy, interpretation or contradiction.

Without prejudice to the Client's right to resort to the competent courts, they may attempt to resolve any dispute through the extrajudicial dispute resolution mechanisms provided for by current regulations when applicable.

25. ORDER CANCELLATION REQUESTS

The Customer may request the cancellation of their order before its shipment by contacting our customer service department through the channels enabled on the Website.

Submitting a cancellation request does not, under any circumstances, imply automatic acceptance of the request nor does it guarantee that the order can be cancelled.

The possibility of canceling an order will depend on its processing status at the time the request is received. Specifically:

• Orders pending manufacture or preparation: may be cancelled as long as the internal processes have not yet started.
• Orders in production, customization or logistical preparation: cancellation may not be possible, totally or partially, as production or preparation processes have already begun that cannot be interrupted without causing costs or losses.
• Orders already shipped or handed over to the carrier cannot be cancelled. In these cases, the Customer must comply, where applicable, with the provisions of this Returns Policy and the legal regime of the right of withdrawal.

Because certain products sold by EL REY DE LAS MOQUETAS SL are manufactured specifically for each order, the Customer must request cancellation as soon as possible after making the purchase. Once the order has entered the manufacturing or preparation stage, EL REY DE LAS MOQUETAS SL cannot guarantee that cancellation will be technically possible.

Receiving a cancellation request does not automatically suspend the processing, manufacturing, preparation, or shipment of the order. EL REY DE LAS MOQUETAS SL will process the request as soon as possible, without this implying the immediate halt of internal processes already underway.

Cancellation requests must be made through our customer service department, indicating the order number and the information necessary for your identification.

EL REY DE LAS MOQUETAS SL will inform the Customer, as soon as possible, whether the cancellation request has been accepted or whether, due to the processing status of the order, it is no longer possible to process it.
